Fayetteville's city council responded to complaints that police aggressively pushed "consent"("Let us search or there's going to be trouble!") searches disproportionately on black citizens by banning the practice.
The cops called in their union mobsters and used their money to overrule local democracy(local government being the only thing close to actual representative democracy left in this country).

at least is going to court and the dept will be forced to defend their practices....might actually be a good thing.
people need to learn to just say no to these searches.
and this is bringing out some gold golo comments:
Quote : | "People seem to think just because they are in their cars they have the search without provacation protection, but in reality that was meant for people and homes to protect americans. When your car leaves your drive way onto public property and is on state property it is no longer your home property..to deny the right of search" |

Jesus Christ.
If you get pulled over, just give them your license, registration, and proof of insurance if requested. Don't answer any other questions, refuse the request of a search, take your ticket and be on your way.
Fuck all police. 3/1/2012 3:31:45 PM |

Quote : | "An analysis of traffic stops over the past two years by The Fayetteville Observer showed that black drivers accounted for three out of every four searches." |
If black drivers didn't also account for 3/4 of traffic stops it would be disproportionate. That, in and of itself isn't an issue, but if it was a substantial variance... say 50 of traffic stops were of black drivers then you could see why it might be viewed as possibly being racial profiling.
Sorry about the double post.3/1/2012 3:40:10 PM |

i swear even 90% of the cops there are black too
so the police force is racially profiling their own race? so lost on this one. 3/1/2012 4:26:06 PM |

although the fayetteville PD was not allowed to ask to search your vehicle, they could radio the sheriff or highway patrol to do it if they wanted to

Whats the real issue here? The city council imposed a temporary ban on consent searches - they have/had zero authority to do so because it goes against state rulings. 3/1/2012 5:12:03 PM |

Consent searches are protected under state law (G.S. 15A-221); municipalities must be consistent with NC and US lawn (G.S.160A-174). 3/1/2012 5:41:51 PM |

but certainly a municipality can direct its own police to curtail content searches, can it not? 3/1/2012 5:47:00 PM |

Staley v. City of Winston-Salem ruled that a city cannot enact any law, ordinance, by-law or other act that prohibits or overrides State statutes.
Wilson v. Mooresville ruled that towns have no authority to restrict or enlarge the power of their police.
Also, the Police departments are a managed by a Chief who is under a city manager; a city manager in North Carolina does not have to answer to the city council.

When I first heard about this case, I thought (and still think) this is insane. A city in north carolina can not direct the city's own police force to be more restricted and reserved in their activities than the state allows. How is this at all logical? I can certainly see reason for not allowing cities to grant new powers to their police forces, but to restrict or take away their powers? By what logic does that make sense?3/1/2012 8:25:16 PM |

Holy shit
Judge acquits militia members of sedition, conspiracy
Quote : | "DETROIT (Reuters) - A federal judge on Tuesday acquitted seven members of a U.S. Midwestern militia group of all major sedition and conspiracy charges against them, two years after the FBI began arresting them following a long undercover surveillance operation.
The seven, members of a group known as the Hutaree, were accused of plotting to kill law enforcement officers as a way to incite a wider rebellion against the U.S. government.
Defense attorneys had argued their actions were protected by their First Amendment free speech rights.
In her ruling on Tuesday, U.S. District Court Judge Victoria A. Roberts agreed, acquitting the defendants on all counts related to sedition, conspiracy to use weapons of mass destruction, training in the use of explosives and using firearms in the commission of a felony." |
This is a HUGE win for the constitution!!
