That's a hell of a story; thanks for typing it up.

I think we're gonna have to start a "Storytime with Restricted thread"...but just continue to drop em in here for now plz

How the fuck did that guy pick up such a large mean dog without getting hurt? That's pretty fucking impressive.

No idea. But I've seen some mind boggling shit in my career. Like a dude hyped up on bath salts, running naked down the street with a police K-9 hanging completely in the air from the guy's flexed bicep (never found the guy, the dog was located around the block).

Is it legal to turn your lights on just to go through a red light then turn them back off once your through? Definitely saw a cop do this in Charlotte last weekend and he didn't appear to be in any hurry.

I once got pulled for having no side view mirrors (jeep wrangler with doors off). that's some bullshit!

is having at least a driver side mirror really the law?

my mom got scared And said you're moving with your auntie and uncle in Bel Air adding aftermarket mirrors that attach to the windshield frame.

It is a lot easier to see to the right than the left with no mirrors.

I drove my jeep like that once and quickly realized that a mirror was necessary. Once I got the passenger one it sucked because that one you could ONLY see with the doors off, with the soft door in it was not visible.

Apparently Saturday night (~11 PM) my buddy was driving down a cut threw road that contains 3 stop signs. He lives in NoDA which is a gentrified neighborhood surrounded by the ghetto. After stopping at the first stop sign and proceeding through the intersection he noticed a police officer on the perpendicular road who proceeding to turn right to now be behind my friend.

Not thinking twice about it, my buddy proceeded to stop at the next two stop signs finally taking a left onto the main road. After the third stop sign while he was pulling onto the main road, the cop turned on his lights and pulled my friend over.

According to my friend the cop walked up to his cracked window and without stating the reason for the traffic stop requested his license and registration. My friend says he politely stated that he didn't consent to handing over his license and registration without knowing why he was being stopped. They ended up getting into an argument with the cop stating that he would be arrested if he didn't present the requested information; at no time informing my friend the nature of the traffic stop. Finally the cops loses patience and with back-up arriving opens my friends door and proceeds with the arrest.

At no time during the arrest, my friend claims, were his miranda rights read. He was informed he was being arrested for refusal to cooperate with a police officer and overheard the arresting officer tell one of the cops that showed up, as back-up, that he witnessed my friend run a stop sign. The cops than proceeded to search his vehicle which I thought was illegal to do for a routine traffic stop without a warrant unless the police felt they were in clear and present danger (which would have been a No since my buddy was in handcuffs)

I've been friend with the guy since I was 13 and if he ran the stop sign he would own up, taking responsibility. My question does a police officer have to inform a person of the reason for a traffic stop before they can demand their information? My friend swears you do not but I think he could be wrong.

Honestly I think the officer was fishing (potential DUI, drugs catch, etc) and when my friend started making the cops life difficult, the officer fabricated the stop sign violation to give themselves a reason for the stop.

if you get arrested they can search your car without your consent, and your friend was required to identify himself when asked.

Honestly you'd probably like my buddy Jeepin. He's a frequent at PMTBR too.

Not sure what his deal was. Think he's going through a fuck the system kind of phase. I told him he should have just handed over his ID and registration.

Quote :

My thoughts....

Yeah he was taken in, had to post bond and got the running a stop sign ticket. He's going to subpoena the camera of the officer doing the stop to fight the stop sign ticket although from what it sounds he was wrong for not handing his ID over.

I have always found just being honest and respectful to cops gets you much further than anything else. I have been pulled twice for 90+ in a 55 and both times received warning tickets. I simply owned up to it and apologized and told them why I was going so fast and once they ran my license and realized I wasnt a criminal let me on my way and told me to slow the fuck down.

§ 20-29. Surrender of license.

Any person operating or in charge of a motor vehicle, when requested by an officer in uniform...who shall refuse, on demand of such officer or such other person, to produce his license and exhibit same to such officer or such other person for the purpose of examination, or who shall refuse to surrender his license on demand of the Division, or fail to produce same when requested by a court of this State, shall be guilty of a Class 2 misdemeanor

There is NO requirement to be read them when you are arrested, only when custody and interrogation are present.

Wrong. See Carroll v. United States.

I don't mind criticisms of law enforcement and police officers, but there is a ton of misinformation that gets passed on by internet lawyers and hippies.

There was some ~2007-2008 NC supreme court ruling where if one gets pulled over for a traffic violation (aka speeding) a NC police officer can't use that as
probably cause to search for drugs, illegal weapons, etc. I think once my friend was arrested this protection was gone as it was
no longer a "traffic stop" but a failure to "surrender of license".

Quote :
"That's called police work."

To arbitrarily pull people over? This happened to me twice in Wilmington. Both times it was apparent he was fishing for a DUI.
One of the incidents i was in my gym clothes (about to go to bed), doing a favor for my buddy taking him and friends downtown. The officer said he pulled me
for a tag light being out. Kept asking if I had been drinking, where I was going that evening, and how they don't tolerate drinking
and driving in "their town". The car i was driving was a rental and I told him that I was just dropping them off then going home to bed as it was a
work night. I got home and discovered my tag light wasn't even out btw....

First and foremost, Supreme Court decisions tend to trump State laws. You can pull someone over for speeding and develop probable cause outside the scope of the original stop and search the car. Now how long you can extend to find the PC to search a car, etc would take several hours to go over.

Quote :
"To arbitrarily pull people over? "

See Whren v. U.S.

As long as I have a lawful excuse to pull you over, I can sniff for other things as long as I can articulate reasonable suspicion that another crime is afoot.

In the past, I've seen wanted people driving, told them I stopped them for a tag light...confirmed the warrant and arrested them. I did it a lot with drunks too. It relaxes them, they think are they are just getting pulled for something stupid and that I have no idea they are drunk. I get them to talk to me (developing reasonable suspicion) and then have them step out. If I walk up there like billy badass and accuse them of drinking, they will just be dicks.

The Carroll Doctrine would still apply. Up until a few years ago, if you were arrested on a traffic stop it was basically a free search for law enforcement. That was made moot by Arizona v. Gant (which was a bad case based on stupid police work) unless you can articulate that the evidence of the crime is located in the car. I could see if the driver acknowledged that he had a license on him or in the car but was refusing to hand it over, the officer would be justified in searching the car for that license or any documents that could identify the driver. However, the officer may have developed some sort of probable cause too.
