Jethroe- From what I can tell with the use of a directional signal that's a legal left turn. It's an unprotected median in which the double yellows are just for passing. That would be the same as if it were just a normal straight double yellowed divider.

Do you or does anyone else on the force ask people about insurance when they pull someone over?

Is it possible to get cited for DDing for a friend who obviously doesn't have you on their policy? I always wonder about that. As I understand it, the officer has the legal right to ask for 3 things, which are license, registration, and proof of insurance.

Know any officers that are a little bit TOO into the paramilitary thing? You know what I mean....the ones that want their special gun instead of the standard issue, and who voluntarily wear the bullet proof vests for crossing gaurd duty, and who visit the army surplus store weekly to get the latest combat knife/pepper spray/flashlight contraption ?

Let me get your opinion on the following scenario:

Let's say there's a 2 lane road (1 lane each direction) and the car ahead of you is stopped, waiting to make a left turn. There is a wide shoulder on the side of the road. Is it legal to pass the car ahead of you using the shoulder on the right? And if not what would the citation be and how likely would you be to issue a ticket for that infraction?

Can you get pulled for cruising in the left lane on the interstate, when you're not passing someone in the right? I was taught in driver's ed that the left lane is for passing only, and after you pass, you merge back into the right lane. There are signs on the highway that say "slower traffic keep right". Does that mean that as long as you're doing the speed limit, you can stay in the left, and cars going slower than the speed limit have to stay to the right.

I hate those people who cruise in the left lane, especially the ones that get beside a car and go the same speed limit for miles, not allowing anyone to pass.

Sure do. But I'm a gear queer - the department issued flashlight sucked, so I bought a surefire. I also have a light on my sidearm because I hate having two things in my hands. 99% of the people here use issued guns. Those who don't are either firearms instructors or females. I bought an Aimpoint for my rifle, it just fits my application better than iron sights. Some people wear drop downs when they work patrol for no real reason other than it looks cool. Just depends.

If you caused a wreck, yes sir and I might stop to see what your hurry is about. I don't have time to pull up the statute (I'm in school on lunch break).

Yes, there is a specific speed statute about that but I think there has to be a minimum speed limit posted. You could also be cited for failing to obey highway signs. Again, don't have time to post the statutes.

Twice in my life i've gotten the blue lights at night on a 2-lane road that didn't have a marked shoulder and the actual shoulder was uneven, or a straight up ditch.

Both times I put on my flashers and pulled over ASAP (either into the first parking lot or there was a shoulder - marked or level terrain, or in a parking lot). Both times that was at least 1/4 mile or so down the road, probably a little over 1/2 mile on one occasion . Both times the respective officer seemed upset that I didn't pull over immediately --- i understand that it makes them wonder, but I'm not risking pulling my car over into a ditch and causing damage.

What's the best course of action here? Should you just stop in the road?

Years ago, I was on Franklin Street in Chapel Hill on halloween night, with some friends. Moving through the crowded street, there was a passed-out-drunk guy with a police officer standing over him (presumably to keep him from being trampled by the crowd). I had my camera with me, so I raised it to take a picture. The police officer then put his hand on my arm, and forced my camera down while saying "YOU DON'T NEED TO TAKE A PICTURE OF THAT!". I just let it go and walked on, seeing how I was already not so sober, and figured challenging the officer would probably get me thrown in jail for the night.
Still, years later, I didn't appreciate being touched...or being told I couldn't take a picture when I felt I was legally able to do so.

What's your opinion on all of this?

I personally don't think you did wrong, But like I previously said, from personal experience as well. As soon as someone delays pulling over for some time it starts turning on all the light switches and makes the officer fire on all cylinders.

90% of the time if someone takes an extended period or distance to pull over, they are either getting ready to jump and run, stashing contraband, stashing a weapon, spraying odor concealer etc etc... So when you finally get to a spot to stop, I'd expect that officer to be a bit amped up when he first gets to your window. But after you tell him why you delayed your stop it may make him tone down a bit, but i'm sure he/she will still be on high alert.

nothing personal, just on the majority of those occasions it's something that can greatly effect his/her safety. Rarely it will be a someone trying to do right.

It's not illegal to take pictures or video or anything you're legally able to do in public. It only becomes a problem if it is somehow interfering with whatever is going on, jeopardizing safety, or you have entered or refused to leave a "quarantined" area...

As far as the officer touching you, he probably shouldn't have actually touched you. But if you were that close to him, you're in his personal bubble and he is going to use his hands before he lets his guard completely down. I'm assuming it was a busy street with people and drunks and a lot going on. It's difficult to control crowds and mobs of people so I'm sure it's nothing personal.

Yeah, crowded street for sure. So crowded in fact that there were probably about 15 other people in his bubble - by nature of the fact that it's a shoulder to shoulder crowd. He kind of reached past people to get to me.

Yeah not safe for anyone in that position, especially him since he was trying to protect the passed out drunk guy... Needless you shouldn't have been any concern of his, your hands were full of camera, not a weapon...

Moral of story, you went to chapel hill :-p don't do it again.

Thanks for the answer. Perhaps I wasn't specific enough but in the above situation I would certainly slow down. This situation usually arises on 35 mph roads so I would slow to 15-20mph if not more. Both my cars are low slung so the last thing I would want to do is hit something sitting on the shoulder. Line of sight is also important - if I can't see around the vehicle waiting to turn I wouldn't procede. That would be stupid

So what I'm getting from your reply is that if it was a safely executed maneuver you wouldn't care. However it is technically illegal.

nothing. don't fuck with the police. they can fuck you harder than you can fuck them. and unfortunately, most of our society values the words and actions of cops over the general public, even when overwhelming evidence supports the person and not the cop.

so... officer's view of things counts significantly more then yours.

so in a he-said she-said... the LEO ALWAYS wins.

IIRC, and Restricted will correct me, but from what he's told me they are actually one of the most powerful agencies in the state. A lot of younger people only see one small portion of what they actually do and thus the stereotype/reputation of the agency is one sided.

^^yes, but "even when overwhelming evidence supports the person and not the cop." is a major problem.

^sounds familiar. They can also arm themselves with AR and similar rifles and lose them without penalty. Must have some say somewhere.

ALE is the one agency that should be disbanded immediately, if not sooner.

they add nothing useful, and waste our taxpayer dollars.

I'd be fine if we'd fire 'em all and give all the other cops raises.

This.

There is nothing that the ALE does that other LEAs can't do. Prowling minors is a waste of taxpayer money and can be handled by city/county LEOs. Distilling spirits for person consumption should be perfectly legal, much like homebrewing, so busting stills needs to go. Prohibition is over.

Why does the ALE need to enforce lottery laws? Another agency/department is better suited.

Same goes for manufacture, sale, and transportation of alcohol.

Tobacco != alcohol, ALE not needed. Besides, do we need LEAs to have part of their mission dedicated to tobacco? Really?

If the NC ALE hadn't proven to be over-funded, reckless, predatory, and essentially useless in today's world, then maybe ALE would be needed. But the simple truth is that it is not needed. And when ALE goes, might as well send the ABC with it.

If you get pulled for a DWI and refuse to blow, can they really take your blood involuntarily or is this just a threat?

If you say "I think" in front of an insult, such as "I think that you are a pig" does it make it legal since it's an opinion?

How does the police radar system work? Is it like a map that shows the relative speeds of all the cars around you?

If you see somebody with a radar detector, are you more likely to pull them than a car without one?

On court days I see cops bring their laptops - are they looking at each respective case as it comes up, or just dicking around on the internets to kill time?

I have a German Shepherd Dog and if I were pulled over while he was in the car, he would undoubtedly growl at the officer - is this legal grounds to shoot him? (I actually used to have a muzzle in the car in fear of this)

If I'm parked on Hillsborough street, say in front of DH Hill on the library side of the street, and when I get in my car and leave, I whip a U-turn from the parking spot to go in the other direction, is this legal? (I doubt it, but thought I'd ask)

Do you extend "professional courtesy" to sons/daughter of cops? I have a friend whose dad is a Sheriff and he's been pulled 2-3 times drunk and speeding and was let off each time. One time, he blew a .16 and they told him to call a friend - this was on Boylan.

Opinions are illegal in North Carolina. USA #1 /HUR

How does the police radar system work? Is it like a map that shows the relative speeds of all the cars around you?

Radio waves bounce of traveling cars. Its only used to corroborate your opinion that a vehicle is speeding. It doesn't tell you which one - say for example on a highway.

No, but its fun to set it on and off at a stoplight.

There really isn't a state statute governing this.

To expand on this, are radar detectors illegal to have (probably a stupid question, and I'm guessing the answer is no)? My car is used and the previous owner had one installed. I'm pretty sure it doesn't work (outdated) and I always leave it turned off because it's annoying.

*As far as the ALE - I think they are necessary because of they way NC is set up. Sure, make ABC private, etc, but that isn't going to happen. Local agencies are stretched pretty thin and don't have the manpower to regulate ABC permit holders (not just enforcement, but a ton of it is administrative side - conducting/approving background of permit holders, violations, etc).

Same goes for lottery and tobacco (remember when Hezbollah was smuggling cigarettes? Goes beyond just status offenses).

Don't forget they also regulate boxing and MMA stuff.

Really comes down to manpower to do things. Could they be merged w/ the SBI? Sure, but this is state of tradition(s) and that would change the mission of the SBI.

ALE also enforces the controlled substance act laws, ie chapter 90 laws in the NC state general statutes. So they are also kind of a vice unit as well. Restricted is right though, no other agency really wants to mess with inspecting, investigating and issuing ABC permits.

on a side note, "chapter 90" is cop code for drugs
