If this is as clear cut as the article makes it, Castle Doctrine should be complete valid Id think. Will be very interesting to see how this plays out given a valid "threat" and trespass.

i read somewhere that shooting a drone is legally the same as shooting any aircraft... because the FAA controls the air, even if it's half a foot over your property.

This guy shouldn't get in trouble, but it also shouldn't be legal for people to be able to shoot at things they see flying in the sky. Too much can go wrong if we allow that carte blanche.
The law should be strict against it, but judges/jurors should have broad leeway to consider the circumstances.

^ There's a CIA pilot training facility in eastern North Carolina. It's not marked on any air maps that a strip is there. My dad sometimes flies over it for fun because "it's not there".
Really it goes back to how laws haven't caught up with how to deal with drones. Seems like there should be some kind of Congress-led law that drones aren't allowed to be inside property markings beneath a certain height unless "invited".

I have trouble believing a drone was shot down from 90 yards away with birdshot. Maybe the drone was a lot closer than being claimed in that video, or the shooter was using something like #4 shot instead. Hopefully not the latter, because I could see #4 shot potentially hurting someone falling back to earth.

hitting it isn't in question; hitting the drone with any energy left in the shot is another story. The shot can travel about 200-300 yards, but the effective range for breaking clays is probably closer to 50 yards. 8/2/2015 11:44:20 AM |

Clays probably break easier than the plastic used in making drones.
It could be possible that the drone wasn't broke by the shot but was rotated off its axis enough that it couldn't regain control. I'm not sure if they are capable of inverted flight. 8/3/2015 8:31:51 AM |
