read the letter, pretty strong and interesting, two things I wonder is whether the offender was actually tested to see how drunk he was and what the average penalty for a case like this is

Does it really matter how drunk he was though? The majority of college kids get shitfaced multiple times without raping someone behind a dumpster then running away when they get busted.

yes. if a person can be so drunk that they their consent can be invalid, that suggests that there is a point at which a person is too intoxicated to be responsible for their actions. If that is true, then logically someone can be so intoxicated that they shouldn't be held accountable for rape.

Taking it to an admitted, but ever so slight, extreme. If someone can be held mentally incompetent through insanity and other such categories, then drunkenness isn't so different.

how are they different? in both situations a person has to understand what they are doing.

again, we acquit or lessen the sentence of people who are considered not mentally competent, which consists of reasons from retardation to insanity. If that is the case, then we have to accept that a mental state that is altered from the norm, which drunkenness is, alleviates a person from their actions to some degree and that they should be served reduced consequences.

I don't disagree with that. Getting drunk is a choice for both parties involved in intercourse. If someone chose to get drunk, but is chosen not to be accountable for their action of consent, then anyone else who chose to get drunk and participate in that same act of intercourse must also not be accountable for their actions.

I'm pretty sure that all eight people who still post in this forum have seen it by now. And if you want me to feel shame, you might need get a little bit deeper than the various permutations of "this is dumb" that you dump on virtually every thread you encounter. You run around and make short, unelaborated declarations of other people's stupidity It's what you do. I don't feel ashamed for you shitting on my thread any more than I do for the dog shitting on the yard.

I have not changed my mind about the relevance of any of the questions I posed in this thread, nor am I satisfied in the answers offered. The only thing I'm ashamed about is being stupid enough to think they might be addressed in this forum in its current state. TheDuke has me one-upped there; clever enough to come up with the same topic, wise enough not to bother presenting it to this rabble.

"Default proceed" is not "a loophole"... it's essentially a protection against government incompetence taking away the rights of citizens. 90% of background checks are completed instantly, so if it's been 3 days and the feds can't produce anything, you don't lose your rights because they suck at their job. If the FBI isn't competent enough to efficiently check someone's records, the solution is not to give the FBI more power.

If a cop wants to search your home, they need a warrant. They don't simply wait 3 days, say they couldn't get a warrant, then violate your rights anyway.

Democrats love to ignore these basic ideas of "innocent until proven guilty" and "due process" when they frame the issue as deceitfully as they do. The sit-ins from the left are just publicity stunts.
