got an awesome letter from the nc department of revenue. says i didnt file a tax return in 2001, which is patently false. i even recieved a refund.
well they want me to pay 1900 bucks now.
of course its been 5 years and i have thrown out my records from 2001
i have to prove my case.
so far i have contacted my old employer, and they are sending me a copy of my w-2 from that year
my bank is sending me copies of my bank statements from february 2002- august 2002 so i can prove that they made a direct deposit.

save copies of your tax returns for 7 years from now on

Just get all your info for that year and fill out a tax return for that year. As long as it shows that you are due a refund then you should be gravy.
^while that is good advice it isn't always applicable. If you are due a refund, you aren't required to file a return. Although I don't know why you wouldn't get your money back and I guess you wouldn't really know you were due a refund unless you filled out the paperwork anyways.

my mom works for the DOR... stuff like this happens all the time-- their systems are awful. unfortunately my mom isn't in a position to be able to help you... but I can ask her of ways you could prove you're in the right & the state is in the wrong. The state dept. of revenue hounded me incessently about me not paying enough taxes last year, even though I did pay what was owed. I don't know how they didn't catch that sooner - because they actually sent a letter to my employer to doc my pay for my amt. owed. Then a couple of months later, I recieved 2 checks for a refund of the money they were taking out... but, not for the full amount - about $40 less than what I should have gotten.

Request your tax return from the IRS. Thats the easiest way to get all your information.

That will cost you $39, but you will know exactly how you filed your federal and can easily build your NC return.

^^^^ is the best way to get your tax return
if they're still causing issues, talk to a live body at NC Dept of Revenue -- like ncsukat said, their systems are a mess so the warm bodies are usually helpful. and if that doesn't get you anywhere, you could also try getting in touch with your state House / Senate delegation. they're constituent relations folks can help look into issues like this (assuming you really did file your tax return)

My husband got something like that a few years back, except they were trying to say that he never paid any taxes for a whole year and that he owed them well over $1000. He just sent them one of his paystubs from that year, that clearly indicated that they had been removing money from each of his paychecks. They were just like "Oh OK." And then everything was fine.

Isnt there a statute of limitations on this of like 4 or 5 years? where they can not come back and do that? I'm almost 100% postive there is. YOu should look into that
"Statutes of limitations generally limit the time the IRS has to make tax assessments to within three years after a return is due or filed, whichever is later. That particular date is also referred to as the statute expiration date. Statute of limitations will also limit the time you have to file a claim for credit or refund."
But I do not know if that would apply if they think you did not pay. *You might want to ask someone who knows a little bit more about tax law*

I highly doubt they will be able to make them go away with quickness. Nothing relating to the IRS or the NC Dept of Revenue goes away with quickness. Also, if you get a CPA for $50 you wont get what you are looking for.

I believe the statute of limitations in NC is 5 years from when the tax return was due. So a 2001 tax return would be due April 15th 2002. Thus the statute runs out on April 15th 2007, which is the reason why the Department of Revenue is now contacting him. They are runnning out of time. Also, now that they have contacted him they could let this drag on for a while.
Also if you owe them there is no statute of limitations.

All you need to know is several people have attempted to challenge income taxes this way in court and each one was defeated.12/16/2006 11:57:40 AM |

I got one this year for 2004
Problem is, they are saying I owe 19000 in taxes for the stock trading I did.... BS.
So, basically, that was the first year I filed it myself, and assumed they got a copy of everything that scottrade sent me, so when I listed the total amount of "money made" I just did grand totals and listed it as scottrade.
Well, guess that doesnt work, so they took the amount of stock I sold and claimed that all as income, not including the amount that I paid for it all.
So, now I have to write an appeal, and basically redo all my 2004 taxes, for which I cant even remember where the records are since I got married and moved, and my parents probably threw it all away unknowingly.
You would think that they would settle for me just showing them the "bought" and "sold" documents, and just call it settled.

Interesting, they must have had a problem in 2001, cuz i got the same kind of notice.
I did have the copies of my taxes however, and just faxed them in and they let it go.
(After talking to someone alive there first of course)
