Hopefully having the previous nomination stolen from them will motivate the Democrats to quit laying down and pursue something like that, but I'm not holding my breath.

Their prospects in the House look pretty favorable at the moment, but unfortunately for them, as it relates to this development, that's not the case in the Senate.

I really want to see Dems go down swinging on this, but I do think it'll result in a loss ultimately. The GOP will go nuclear on the filibuster and Newt Gingrich will be our next justice. The history books will point to this as the event that finally killed the "world's greatest deliberative body" (which is joke in itself).



Conservatives will challenge every law and policy in our lifetimes to the Supreme Court. Which basically makes it impossible for me to believe that government will be able to address any of the existential problems that plague our country. The future is dim.

re the Travel Ban...

Imagine if Obama had gone around for a year saying he would ban Christians from coming here, enacted a policy that looked like a Christian ban, defended the policy after it was put in place at a campaign rally as a Christian ban-- can anyone see the court ruling the same way?

It seems like we have enough precedent and laws about separation of church and state and religious discrimination, that they would have found some way to make those things apply, without this specific statute having to specify "btw you can't use travel bans as part of a bigoted agenda".

What do you guys think about Barrett? I don't know much about her, but it looks like she's in Trump's crosshairs to be the next SCOTUS member. She's conservative, Christian, and had quite a few Dem votes when she was confirmed.

It depends. Did Obama say this as only a candidate, or did he say it while holding the elected office for which he was making the policy? The Court has been extremely hesitant to hold candidates' words against them, because candidates tend to go off on less-than-calculated tangents to rile up crowds. They are also hesitant to guess at an elected official's motives without hard evidence to support it. Had Darth Cheeto said those things as President, there's absolutely no doubt that it gets struck down, similar to how NC's voter ID law got struck down largely on the basis of the email exchanges about race.

There's no doubt in my mind that Trump wanted to ban Muslims, but he did a damn good job hiding that intent while President. That's what mattered when it came to a facially neutral policy which was well within his statutory and Constitutional authority. The Court didn't want to set a precedent that candidates need to parse every single word they say on the campaign trail with an eye to future Constitutional challenges. It also probably didn't hurt that he softened the travel ban's restrictions
