The person named as the head, even as 'Acting', must be a senate confirmed position (ie you could ask a deputy head of another agency) or someone who is pretty high up who served in that agency for at least 90 days during the 365 days preceding the end of the previous Senate-confirmed officeholder's service. So you could potentially pick a career apolitical person, but it would still be tough
