this may have been asked already.
If the speed limit is 65 and Car A is in the left lane doing 65 exactly --- Meaning that Car A is doing the maximum speed limit and that no car in that lane could travel faster than them without breaking the law --- ignoring the fact that it's somewhat douche baggy if there are vehicles behind Car A who would like to travel faster (and break the law in doing so), is Car A doing anything that's actually illegal?

car A should move to the right lane, unless they are passing someone going under the speed limit. in theory.

see, that's what I always hear. But i've searched the statutes and haven't found anything that suggests that to be the case. It's certainly the "rules of the road" way to do things. I think it's pretty dickish to not move over. But are there actually any laws in NC pertaining to the issue?

You can go whatever speed you want in the left lane as long as you don't impede the flow of traffic, but "impeding traffic" is not clearly defined. The police can only enforce a minimum speed limit if posted. So, if grandpa wants to do 25 mph on 70 mph highway at 2am in the left hand lane and he isn't impeding the flow of traffic, truck on.

There is advancement at the old department, but one of the reasons I left was because I wasn't sure when that opportunity was going to come for me. At my current gig, there is no room for advancement because its such a niche agency (no specialty units). However, in the last year I have gained invaluable experience that has bolstered my resume tenfold. No, got to start at the bottom. Because I have been gone a year, they can't offer me the pay I left at but they would give me a signing bonus that would put me $2 less than the salary I left at. After 1 year, I would get a probationary raise that would keep me at that the $2 less salary until promotion.
The only fringe benefit that would work in my favor is the opportunity to moonlight and work city OT.
Right now, the ball and chain is only working part-time because she is back in school and won't be drawing a full time paycheck until mid-summer at the earliest.
I need to figure out my end game; where I want to be in 5 years. I wouldn't mind going back home to D.C. but the cost of living is outrageous, but this state blows as far as policing. If I wanted to go feds, I got a better shot boosting my resume at my current position, but as I said, its brutal.

Depends. Ignore the pay for a moment (as long as you can cover your bills and responsibilities on either salary) and focus on whether staying another year in your current position would be enough of a resume boost to offset the fact that you're miserable. You may not be able to put a price on happiness but you can sure try to fit it into a cost-benefit analysis.
Also, a question. You have a 4-lane road with a median. It runs through a residential area so speed limit is 35. This road intersects a small non-divided street. In the middle of the intersection there is a fucking big stone monument. Solid 10 feet in diameter, probably 15 feet tall, big motherfucking globe on a piillar. This makes navigating around it tricky, especially given that the roads do not meet squarely but at a slight angle, so there is a no left turn sign on the larger road at the monument intersection. Understandable because someone who is not familiar with that intersection is going to be confused to say the least.
Suppose that I regularly ignore that no left turn sign because that's the most convenient turn for me and I know exactly how the intersection flows. Is that ticket-worthy as a matter of course, or only if I appear to be making the turn in a dangerous fashion? 1/3/2014 2:06:00 AM |

1 - make a right on red 2 - do an immediate u-turn and continue on.

I like CCH holders for the most part. I have arrested one or two, but for the most part I like to shoot the shit with them and ask them what they are carrying. I'm probably less likely to give them a ticket, but I'm not a big ticket writer.
The PBA stickers and such...I don't pay them any attention.

A coworker of mine just lost his license for a year due to a DUI, but he got a provisional license that allows him to drive between 7AM-8PM M-F, and pretty much any other time as long as it's for work/community service/alcohol classes. He also has a stipulation that his BAC must be .04 or below for the next 3 years. We were discussing some scenarios yesterday and I wanted to get po-po feedback.
1. I assume when an officer runs his tag it will come back that his license is suspended. Will the officer also be able to see that he has provisional driving privileges, or would the officer need to pull him over to find that out?
2. If the answer to question 1 is "no, the officer would need to pull him to find out", is just running the tag/finding out he's suspended enough probable cause to pull him? In other words, can a cop just pull him based on a random tag search, or does he have to have another reason to pull him (speeding, tail light out, etc.)?
3. His lawyer told him that if an officer runs his tag he will see the .04 BAC restriction, and that the officer will most likely approach the vehicle with a breathalyzer and make him blow. Is this true, or would the officer need some other evidence of intoxication to request he blow? (smell of alcohol, slurred speech, etc.)? 1/8/2014 10:53:59 AM |
