This thread concers both other ones that are currently ongoing. But it cannot be combined with any. Therefore i will go ahead and make a new one in hope of hearing your honest oppinions about the situation:
I have a friend whos's an RA. i would like to keep his name undisclosed just because he would get in trouble if the authorities found out i made this tread. Just to keep his name clear, i am doing this on my own will without his persuation. Anyway, he's an RA. He spoke up against The RA who wrote up all of those poor kids in Alexander. Now he's on the verge of losing his job, his RA position, because he expressed his freedom of speech and it went against University Housing policies of employment blah blah blah. As of right now, University Housing put a gag order on him, saying he is not allowed to speak up about the situation and if he does, he is up for grounds of immediate termination. As a friend i must post this tread for him and i hope there are people out there that agree with me on the point that what University Housing is doing is wrong and FIRING someone for expressing their opinion is cruel and unusual punnisment and goes against UNITED STATES CONSTITUTION.
P.S. if anyone knows who i'm talking about, please DO NOT disclose this person.

with that said, he should be given the right to dissent if he wishes, and if he is professional about it in a closed door meeting, that should not be grounds to be fired

Its like this, you halfway outed your friend because now we all know that its a HE and not a SHE, thereby exhonorating all females. Furthermore, only a handful probably spoke up... further limiting the pool. YOU ARE FUCKING STUPID.

but any way....

You CAN fire someone for their opinion. its not a violation of the 8th ammendment. To say so would be fucking stupid. However, it may be grounds for a wrongful termination law suit. But, like i said you can fire someone for their opinions if they differ from the employer's. The only way to win wrongful termination suits are to prove the firing was on the grounds of race, creed, religion, ethnicity, sexuality, gender, etc. OR if it is found to be in breach of contract.

But honestly, you are fucking stupid. The constitution is there to protect the citizenry from the GOVERNMENT not civil matters.

but it's such a wrong thing to do, put his ass on probation or something, all he did is speak up against the actions of the other RA, there are many students on this campus who thing that what happened was wrong, so are they going to punish everyone?

Maybe people should not be so foolish as to knowingly post legally compromising photos of themselves on a publicly-accessible website. I don't have any problem with people NARCing. I don't think the defense that "it's not a cool thing to do" would hold up too well in court. Evidence is evidence. I'd like to say "Lesson learned," but I know it will not be.

You are probably right, though. Doing "the cool thing" should probably be one of our primary moral measuring sticks.

who the fuck cares if it's cool or not... they got caught... i spent 2 years living on campus and never got in trouble for the many nights i spent drinking in my suite... then again, i didn't have a bunch of fucking pictures of my illegal activities on the internet with my name and shit beside it...

if i post pictures of me taking a sledgehammer to some guy's car and that gets me caught, i fucking deserve every bit of punishment for doing illegal shit and then posting pictures of it on the internet...

As far as your friend goes, he has no legal claim as far as what is going on. Any employer has the right to place a gag order on any or all employees concerning internal situations. If he violates said gag order, he is subject to termination. He can try to claim wrongful termination, but no lawyer would take the case since it isn't wrongful termination in any way shape or form.

And technically, if they have placed a gag order on him over this, then if he does decide to continue talking about it, his termination would be for violating a direct order from his employer (insubordination) and not for his opinion.

seems pretty gay to me that they would do that, but they can, internet is public domain. And those people participated in illegal activities so its their own damn fault really. So if you are underage and choose to drink or do other illegal activity, you are responsible for any trail you leave.

If you don't do anything illegal then you don't fucking have anything to worry about. Jesus, I mean I drank underage, and I paid for the consequences on multiple occasions.

So these people to need to man up and take their punishment and you need to shut your fuckin mouth.

I'm gonna guess that you are foreign.

First of all, you don't understand the constitution. Cruel and unusual punishment is like when someone gets caught selling a quarter ounce of weed and gets 20years, it is far beyond the established precedent. The ra did not commit a crime, and is not being sentenced, although you may think him being fired is punishment, it's different

Secondly, NC is an employment at will state, which means you can be fired at any time for any cause.

Third, you don't know the english language that well.

Once again, I don't think your friend should be fired if he dissented politely behind closed doors; however, please don't act like some foreigner is going to tell me about american laws and policies, thanks
